Preamble
These general terms and conditions of sale for services (the “Terms”) set out the terms and conditions under which Ms Marie-Claude KACY, trading under the commercial name “Toasana Nutrition” (the “Service Provider”), operating as a sole trader (entrepreneur individuel), registered for her activity under SIRET number 884 531 625 00025, with a professional address at 138 Avenue Victor Hugo, 75016 Paris, France, marie@toasananutrition.com, offers to any adult natural person nutritional therapy and naturopathy consultations provided remotely, to a clientele in France and internationally, with the exception of Canada and the United States (the “Client”).
Consultations are conducted from France. It is the responsibility of any Client residing outside France to verify that use of this type of service is compatible with local regulations. Toasana Nutrition accepts no liability in the event of any incompatibility with local regulations, without prejudice to its own pre-contractual information obligations.
Toasana Nutrition reserves the right to refuse or discontinue any service where applicable local regulations are liable to prohibit or restrict the activity offered. Toasana Nutrition cannot be held liable for any consequences arising from an incompatibility between its services and the regulations applicable in the Client's country of residence.
These Terms apply, without restriction or reservation, to any purchase or booking of services offered by the Service Provider on its website, regardless of the means of booking (email, telephone or via the Website).
The Client is required to read these Terms before requesting a consultation. Confirmation of a consultation booking constitutes full, unreserved acceptance of these Terms, which shall prevail over any other conflicting document.
The Service Provider reserves the right to amend these Terms at any time. Amendments take effect as soon as they are published online and apply to any booking made after their publication. The Client is invited to review this page regularly.
These Terms apply to all advisory services provided by Toasana Nutrition, regardless of the Client's place of residence.

Article 1 – Purpose – Nature of the Services
Nutritional therapy and naturopathy are complementary, individualised approaches aimed at supporting overall health and wellbeing. Toasana Nutrition uses various tools (health questionnaires, food diaries, functional tests) to identify imbalances that may contribute to the Client's health concerns and to formulate personalised recommendations regarding diet, lifestyle and nutritional supplementation.
These practices are complementary and non-medical in nature. They do not replace a consultation with, or care provided by, a qualified healthcare professional. They do not permit the establishment of a medical diagnosis, nor the prescription or modification of medical treatment.
Any medical treatment put in place for the Client by their regular doctors must be continued (unless otherwise advised by those doctors).
The Service Provider is bound by a best-efforts obligation (obligation de moyens) in relation to advice and information.
Toasana Nutrition undertakes to comply with the following principles in the conduct of its activity:
Confidentiality: all information exchanged is strictly confidential and protected in accordance with the GDPR.
Respect for the client: every client is welcomed without discrimination or judgment, with care and professionalism.
No substitution for a doctor: no medical diagnosis or treatment is offered.
Caution: all recommendations take into account the client's state of health, current treatments and particular circumstances.
Continuing education: Toasana Nutrition ensures the regular updating of its knowledge and the quality of the information it provides.

Article 2 – Booking Arrangements for Videoconference Consultations
Consultations may be booked directly via the website toasananutrition.com or by any other means of contact available on the website. Any booking is confirmed upon partial or full payment of the corresponding fee.
To benefit from a remote consultation, the Client must have a stable internet connection and be available at the agreed date and time.

Article 3 – Fees and Payment
Consultation fees are set by Toasana Nutrition and clearly indicated on the website and the booking platform. Fees are expressed in pounds sterling (GBP) and/or euros (EUR), depending on the relevant market.
The fees in effect are those displayed at the time of booking. Toasana Nutrition reserves the right to change them at any time, without such changes affecting bookings already confirmed.
Prices shown are inclusive of all taxes. Toasana Nutrition benefits from the VAT exemption scheme (franchise en base de TVA) provided for in Article 293 B of the French General Tax Code (Code général des impôts). Accordingly, VAT does not apply to the services invoiced.
Accepted payment methods are specified on the booking platform. Payment is due at the time of booking and may be made in full or in instalments, depending on the options available.
The Client is advised that naturopathy services are not reimbursed by French social security (sécurité sociale).

Article 4 – Cancellation Policy
The Client may cancel or reschedule a consultation by contacting Toasana Nutrition by email. Any cancellation made with at least 24 hours' notice before the appointment time will not be charged. Any cancellation notified less than 24 hours before the appointment will be charged in full (i.e., £140 or €160 for an initial consultation, or £70 or €80 for a follow-up consultation).
In the event the Client is late, Toasana Nutrition will wait up to 15 minutes after the scheduled start time. Where the delay is 15 minutes or less, the consultation may proceed as normal, although it may be shortened by the time lost. Beyond 15 minutes, the appointment will be deemed missed and charged in full.
The Service Provider further reserves the right to cancel, suspend or discontinue services if, after signature of the Contract, it becomes apparent that such services are manifestly incompatible with, or unsuited to, the Client's personal circumstances (illness, pregnancy, particular vulnerabilities, disability, age, etc.). In such a case, the Service Provider undertakes to reimburse the Client on a pro rata basis for services not yet provided.

Article 5 – Conduct of Consultations
Following booking, the Client and Toasana Nutrition undertake to be available on the agreed date and at the agreed time. The Client undertakes to provide the requested documents (health questionnaire, food diary) at least 72 hours before the consultation. Failing this, Toasana Nutrition reserves the right to reschedule the appointment.
Following the consultation, Toasana Nutrition undertakes to provide the Client with personalised recommendations on nutrition, lifestyle and supplementation within a maximum of 10 days.
Exchanges by email or messaging cannot replace a follow-up consultation. Requests requiring detailed analysis will be dealt with in a further consultation.
Any inappropriate communication by the Client (abusive, discriminatory or obscene remarks) will result in the immediate termination of the session, without refund.
Consultations may not be recorded by any means whatsoever without the prior written consent of both parties.

Article 6 – Client Undertakings
By consulting Toasana Nutrition, the Client undertakes to:
Inform Toasana Nutrition of any medical diagnosis, confirmed or intended pregnancy, medication, upcoming surgery, or dietary supplement currently being taken.
Inform their treating doctor of the nutritional strategy proposed by Toasana Nutrition, and authorise the latter to contact them where necessary and where this has been agreed in advance.
Contact Toasana Nutrition for any clarification concerning the proposed nutritional programme, in particular the dosage, duration and manner of taking dietary supplements.
Not share the personalised recommendations provided to them with third parties, as these are prepared solely for their personal situation.
Immediately inform Toasana Nutrition of any adverse effect occurring in the course of the programme.
Not modify or discontinue any treatment prescribed by a healthcare professional without that professional's prior agreement.
Article 7 – Functional Tests
Functional tests recommended by Toasana Nutrition (biological panels, microbiome analyses, etc.) are offered solely for the purpose of nutritional personalisation. They are optional, non-medical, and are not intended to establish a diagnosis. Results are interpreted within the context of the nutritional programme and do not replace a medical assessment.

Article 8 – Consultations with Minors
Consultations for clients under the age of 18 may only take place with the written consent of a legal representative (parent or guardian). The presence of a parent or legal representative is mandatory at the first consultation. For subsequent sessions, written authorisation may suffice, depending on the minor's age and maturity.
Toasana Nutrition reserves the right to refuse a consultation in the absence of parental consent or in the event of doubt as to the identity or authority of the legal representative.

Article 9 – Right of Withdrawal
In accordance with Article L.221-18 of the French Consumer Code (Code de la consommation), the Client has a period of fourteen (14) days from the day following confirmation of the order to exercise their right of withdrawal, without having to give reasons or pay any penalty, except, where applicable, for return costs or transaction fees charged.
Where the consultation is scheduled for a date falling within the withdrawal period, the Client is expressly informed that, by requesting performance of the service before the end of that period, they accept the following consequences, in accordance with Articles L.221-25 and L.221-28 of the Consumer Code:
if the Client withdraws after performance has begun but before the service has been fully performed, they will be required to pay the Service Provider an amount corresponding to the service actually provided up to the point at which they notify their decision to withdraw, such amount being proportionate to the total price agreed;
once the service has been fully performed, and provided the Client has expressly consented to such early performance and acknowledged that they will lose their right of withdrawal upon its completion, the Client may no longer rely on the right of withdrawal.
The Client's express consent to early performance of the service, and their acknowledgment of the loss of the right of withdrawal upon completion of performance, is obtained at the time of booking, by ticking the following statement: “I expressly request that performance of the service begin before the end of the 14-day withdrawal period and acknowledge that I will lose my right of withdrawal once the service has been fully performed.”
Should the Client wish to withdraw after having accepted these Terms, the Client may use the withdrawal form below, although use of this form is not mandatory. To meet the withdrawal deadline, it is sufficient for the Client to notify the Service Provider by email of their intention to withdraw before the period expires.

The Service Provider will acknowledge receipt of the Client's withdrawal request.

Article 10 – Liability
Toasana Nutrition is bound by a best-efforts obligation (obligation de moyens) in the performance of its services. It undertakes to apply all skill, diligence and knowledge reasonably necessary to carry out the proposed programme of care.
The Client acknowledges that the recommendations made in the course of consultations are based, among other things, on the information the Client provides and on their personal involvement in implementing the advice received.
Accordingly, Toasana Nutrition cannot guarantee any particular result, improvement in health, weight loss, resolution of symptoms, or any other specific benefit at the end of the programme.
The services offered by Toasana Nutrition fall exclusively within the field of nutrition and lifestyle advice. They constitute complementary wellbeing approaches and cannot under any circumstances replace a consultation, diagnosis, medical opinion, treatment or care provided by a doctor or other qualified healthcare professional.
Toasana Nutrition does not carry out any medical act and does not make any diagnosis, medical prescription, or modification or discontinuation of treatment.
The Client remains solely responsible for decisions taken concerning their health and undertakes to consult a suitably qualified healthcare professional for any medical matter.
Where the Client is receiving medical or paramedical care, the Client is invited to inform the relevant healthcare professionals of the nutritional or supplementation recommendations offered as part of their programme.
Toasana Nutrition cannot be held liable for consequences resulting from:
inaccurate, incomplete or erroneous information provided by the Client;
failure to follow recommendations made;
discontinuation or modification of medical treatment without the prior agreement of a healthcare professional;
inappropriate use of recommended dietary supplements;
pre-existing conditions or circumstances beyond its control.

Article 11 – Force Majeure
The Service Provider's liability cannot be engaged in the event of non-performance or delay in performance of its obligations resulting from a case of force majeure within the meaning of Article 1218 of the French Civil Code (Code civil), i.e., an event beyond its control which could not reasonably have been foreseen at the time the contract was entered into, and the effects of which cannot be avoided by appropriate measures.
Cases of force majeure include, without limitation: major technical failures affecting the videoconferencing platform or telecommunications services, widespread network or power outages, cyberattacks, epidemics or pandemics preventing the Service Provider from working, the Service Provider's sudden illness, and any other event recognised as such under French case law.
In such circumstances, the Service Provider will inform the Client as soon as possible and offer to reschedule the consultation to a later date agreed between the parties, at no additional cost or penalty of any kind. If rescheduling proves impossible, or if the impediment continues beyond a reasonable period, the Client may obtain a full refund of amounts paid for services not performed.
The Client likewise undertakes to inform the Service Provider as soon as possible in the event of a force majeure event preventing them from keeping an appointment. In such a case, and upon presentation of supporting evidence, the cancellation penalties set out in Article 4 will not apply.

Article 12 – Intellectual Property – Copyright
All content on the Toasana Nutrition website, including text, editorial content, visuals, logos, graphics, photographs, videos, downloadable documents, educational materials and, more generally, any content accessible on the website, is protected under the French Intellectual Property Code (Code de la propriété intellectuelle) and remains the exclusive property of Toasana Nutrition or its authorised partners.
Any reproduction, representation, distribution, adaptation, modification, publication or exploitation, in whole or in part, of such content, by any means and on any medium whatsoever, is prohibited without the prior written authorisation of Toasana Nutrition.
In the course of the services provided, Toasana Nutrition may give the Client various personalised documents and materials, including consultation summaries, nutritional programmes, dietary and lifestyle recommendations, supplementation protocols, educational materials, practical guides, or any other document prepared as part of the programme (the “Content”).
This Content constitutes work protected under the Intellectual Property Code and remains the exclusive property of Toasana Nutrition.
The Client is granted only a personal, private and non-commercial right to use the Content provided to them. Such Content is strictly for their personal use and has been prepared with regard to their individual circumstances.
Accordingly, the Client shall not:
reproduce, distribute, publish or communicate the Content to third parties;
market or exploit the Content for professional or commercial purposes;
modify, adapt, translate or alter the Content without the prior written authorisation of Toasana Nutrition;
use the Content for the benefit of anyone other than themselves.
Any unauthorised use of the Content, or of any other protected material belonging to Toasana Nutrition, may constitute an act of infringement (contrefaçon) engaging the liability of its author, in accordance with Articles L.335-2 et seq. of the Intellectual Property Code.
The provisions of this Article shall remain in effect throughout the contractual relationship and after its expiry or termination, whatever the cause.

Article 13 – Protection of Personal Data
In the course of its activity, Toasana Nutrition collects and processes personal data concerning the Client, including health-related data, which constitutes a special category of data within the meaning of Article 9 of the General Data Protection Regulation (GDPR).
Toasana Nutrition acts as data controller. The processing of health data is based on the Client's explicit consent, obtained at the time of booking, in accordance with Article 9(2)(a) GDPR. The Client may withdraw consent at any time, without affecting the lawfulness of processing carried out prior to withdrawal.
Toasana Nutrition undertakes to process only the data strictly necessary for the Client's programme of care, not to sell or transfer such data to third parties for commercial purposes, and to impose on its processors a contractual obligation of confidentiality and security in accordance with Article 28 GDPR.
The detailed arrangements for processing — purposes, legal bases, categories of data collected, identity of processors and hosting locations, safeguards for transfers outside the European Economic Area, retention periods, security measures, and all of the Client's rights (access, rectification, erasure, restriction, objection, portability, withdrawal of consent) and how to exercise them — are set out in the Privacy Policy available at all times on the website toasananutrition.com, which forms an integral part of these Terms.
The Client may send any request relating to the processing of their data to: marie@toasananutrition.com. The Client also has the right to lodge a complaint with the Commission Nationale de l'Informatique et des Libertés (CNIL — www.cnil.fr) or, for clients residing in the United Kingdom, with the Information Commissioner's Office (ICO — www.ico.org.uk).

Article 14 – Governing Law – Disputes
These General Terms and Conditions of Sale are governed by French law, without prejudice to any mandatory provisions more favorable to the consumer under the law of their habitual country of residence.
The language of this contract is French; where it is translated into other languages, only the French text shall be authoritative in the event of a dispute.
In accordance with Article L.612-1 of the Consumer Code, the Client is informed that they may, in any event, have recourse to consensual mediation, in particular through a mediator referenced with the Commission de la médiation de la consommation (Consumer Code, Art. L.612-1), to any sectoral mediation body, or to any alternative dispute resolution method (such as conciliation).
The official mediation platform can be accessed at: https://www.economie.gouv.fr/mediation-conso.
In the absence of an amicable resolution of any dispute between the parties, the French courts shall have exclusive jurisdiction, subject to any mandatory jurisdictional rules applicable to consumers.
